Welcome to Pixymora. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you") and Pixymora ("Pixymora," "we," "us") regarding your access to and use of the Pixymora website (pixymora-development.web.app / pixymora.com), thumbnail generation engines, image editing APIs, and related creative services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not access or use Pixymora.

1. Eligibility & Accounts

• You must be at least 13 years old (or the legal age of majority in your jurisdiction) to use Pixymora.

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Services & Credit System

• Pixymora provides AI-assisted YouTube thumbnail generation, image upscaling, background separation, prompt optimization, and visual design tools.

• Access to generation features requires active generation credits or an active subscription plan. Each generation task consumes digital credits according to the model and resolution selected.

• Subscription plans automatically renew at the end of each billing cycle unless cancelled prior to renewal through your account settings.

3. Intellectual Property Rights & Ownership

• Your Generated Content: Subject to your compliance with these Terms, you own all rights, title, and interest in and to the thumbnail images generated through your paid or credited account. You are granted full commercial rights to publish, monetize, and distribute these thumbnails on YouTube and any third-party media platforms.

• User Uploads: You represent and warrant that you own or have obtained all necessary permissions, licenses, and releases for any images, brand logos, creator likenesses, or graphics that you upload to Pixymora. You must not upload copyrighted or trademarked materials belonging to third parties without authorization.

• Platform Property: The Pixymora platform, website design, trademarks, logos, algorithms, and interface elements remain the exclusive intellectual property of Pixymora.

4. Acceptable Use Policy

You agree not to use Pixymora to generate or distribute content that:

• Is unlawful, defamatory, harassing, sexually explicit, abusive, or promotes violence or illegal acts.

• Deliberately deceives or misleads viewers in violation of YouTube Community Guidelines, including fraudulent impersonation or malicious clickbait.

• Involves automated scraping, reverse engineering, or intentional degradation of Pixymora's servers or AI infrastructure.

5. Disclaimers Regarding AI Outputs

• Pixymora utilizes advanced artificial intelligence models to assist thumbnail creation. Output is generated probabilistically based on your prompts and inputs.

• Pixymora does not guarantee specific YouTube click-through rates (CTR), viewer impressions, monetization outcomes, or channel subscriber growth.

• The Services are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Pixymora and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Services.

7. Termination

We reserve the right to suspend or terminate your account and access to our Services immediately, without prior notice or liability, in the event of a material breach of these Terms or abuse of our compute resources.
